Unless the parties agree otherwise in writing, the carrier shall not be liable for any special, consequential or other damages caused by mere delay in the delivery of a shipment, regardless of the cause of such delay.

The carrier shall not be liable for any loss, damage, destruction or unreasonable delays arising from the following causes:

• Acts of God, the Queen’s or public enemies;
• Riots;
• Strikes;
• Authority of law;
• Defects or inherent vice in the goods shipped;
• Act of default of the shipper or owner of the goods;
• Nuclear reaction radiation or radioactive contamination.

The CLIENT acknowledges and accepts LES MESSAGERIES DU GRAND MONTRÉAL INC. refusal to transport, under the terms of this bill of lading, any dangerous goods or goods of extraordinary or unknown value. LES MESSAGERIES DU GRAND MONTRÉAL INC. standard rates and tarrifs are based on a maximum shipment value of $4.41 per kilogram and, accordingly no tenders, bids, bonds, jewels, precious metals, furs, money, negotiable effects will be knowingly accepted for transport by LES MESSAGERIES DU GRAND MONTRÉAL INC. unless the CLIENT declares the nature and value of such shipments and that he elects to pay the Declared Value Surcharge option on the face of this bill of lading. LES MESSAGERIES DU GRAND MONTRÉAL INC. shall always retain the exclusive right to assign, in whole or in part, the transportation services to be performed under the terms of this bill of lading, to any transportation undertaking, including those by air, rail or sea. LES MESSAGERIES DU GRAND MONTRÉAL INC. shall further always retain the right to refuse to release goods in its custody damaged during shipment due to faulty packaging unless a full release is given in writing by the CLIENT. In the event of international carriage of any shipment under the terms of this bill of lading, the rules established under the Warsaw Convention shall apply.

A claim by the CLIENT of whatsoever nature, must, upon pain or being forever waived, be made in writing, supported by proof of declared value, by registered mail to the LES MESSAGERIES DU GRAND MONTRÉAL INC. (visit our website www.mgmcourrier.com for the full mailing address) within sixty (60) days of delivery of shipment in respect to damage and / or partial loss and within nine (9) months of the date of shipment in case of a complete loss of shipment.
